Mario is a prisoner in Yew.
Shortly before Ultima V, Mario had neglected to say that he could only give 40% of his earnings to charity (50% being the law). They tortured him cruelly before putting him in stocks on the town square together with his son Aleyn (for not turning in his father), leaving them to die from starvation.
When the Avatar found him, Mario begged the hero to release him, telling how he'd come into this situation. The Avatar showed Compassion and Justice, jimmying the locks of Mario's and Aleyn's stocks in an unseen moment, allowing them to escape the city.
